phiery does not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. phiery shall not be liable for any loss or damage caused by service interruptions, technical failures, or events beyond phiery's reasonable control, including but not limited to acts of God, telecommunications failures, or government actions.
Nothing in these Terms shall limit or exclude phiery's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
phiery collects, processes, and stores your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using phiery, you consent to the collection and processing of your personal data as described in the Privacy Policy.
phiery will not sell your personal data to third parties. Your data may be shared with third-party service providers who assist phiery in operating the platform (such as payment processors and identity verification providers), and with regulatory authorities where required by law.

In the event of a dispute between you and phiery, you agree to first attempt to resolve the matter informally by contacting phiery support. phiery will endeavour to respond to and resolve complaints within 10 business days of receipt.
If a dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the competent courts of the Philippines. Nothing in this clause shall prevent phiery from seeking injunctive or other equitable relief in any court of competent jurisdiction.
